Indian judiciary stood like a rock behind its judgments and decisions in Memon&#8217;s case. The apex court said there was no &#8220;legal fallacy&#8221; in the issuance of death warrant by the TADA court in Mumbai.<\/p>\n<p>Several influential journalists, politicians and members of civil society had sent a letter to the president asking for him to &#8220;spare him from the noose of the death\u201d. They opined that death penalty was not the answer to terrorism, and underlined that he was not the main accused. To defend this criminal, many arguments have been put forth by these so called \u201cAdarsh Liberals\u201d in our society.<\/p>\n<p>But the question is are their arguments really true or just plain hollow?<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-23740\" src=\"http:\/\/news.entecity.com\/files\/2015\/07\/yak-01.jpg\" alt=\"yak-01\" width=\"700\" height=\"400\" \/><\/p>\n<h2><strong>#1 Yakub surrendered voluntarily in Nepal and then cooperated with the investigations.<\/strong><\/h2>\n<p><strong>Truth:<\/strong> Yakub arrived on Nepal on flight PK 250 from Karachi on the morning of July 21, and was received at the airport by his cousin, who had arrived from India. They stayed at a lodge frequented by suspected agents of Pakistan&#8217;s Inter Services Intelligence (ISI) agency. On July 24, he was flying back to Karachi on Lufthansa flight LH 765. He was at the counter checking in his suitcase. After he crossed the immigration desk an hour later, airport security subjected him to a routine check. An examination of his briefcase revealed 17 different documents, including Pakistani and Indian passports, besides Indian, Pakistani and US currency. He was detained and first Interpol and then New Delhi were informed about his detention. After interrogation in Kathmandu, Yakub was handed over blindfolded at Sunnauli bordering Uttar Pradesh at 3 a.m. on July 28. He was taken to Gorakhpur two hours away, and then flown to Delhi in a special plane.<\/p>\n<p>Had it not been for or a routine security check of his briefcase at the airport, Yakub would be still in Karachi. (<a href=\"http:\/\/indiatoday.intoday.in\/story\/bombay-blasts-case-yakub-memon-arrest-revelations-reconfirm-active-role-played-by-pakistan\/1\/293931.html\" target=\"_blank\">Source<\/a>)<\/p>\n<h2><strong>#2 Yakub cooperated with investigating agencies and assisted them by persuading other members of the Memon family to surrender.<\/strong><\/h2>\n<p><strong>Truth:<\/strong> The subsequent surrender and cooperation was not on account of Yakub\u2019s grand realisation of the error of his ways but the result of the IB\u2019s mandated attempts to nail all the culprits, using all the means available to them.<\/p>\n<h2><strong>#3 Yakub was accused only because he happened to be the brother of Tiger Memon<\/strong><\/h2>\n<p><strong>Truth:<\/strong> Yakub Memon was charged with organising the finances and logistics for securing and concealing the arms cache used in the terror attacks by teaming up with his brother Tiger Memon. It was Yakub\u2019s well-known financial acumen that made the investigators suspect his involvement in the blasts case. During the investigations, it was found that complex financial transactions had taken place through several of Tiger\u2019s accounts. \u00a0He also recruited 15 people to Pakistan for training.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-23741\" src=\"http:\/\/news.entecity.com\/files\/2015\/07\/yak-02.jpg\" alt=\"yak-02\" width=\"700\" height=\"400\" \/><\/p>\n<h2><strong>#4 Yakub was only a State witness<\/strong><\/h2>\n<p><strong>Truth:<\/strong> \u00a0Usman Jan Khan was the state witness. The confessions of Mumbai estate agent Mohammed Usman Jan Khan sealed the fate of Yakub. Khan, a key conspirator in the blasts who received ten days&#8217; arms and RDX training in Pakistan and planted a car bomb at Sena Bhavan which killed 50 people, said he repented his actions and turned approver four months after his May 10, 1993 arrest. His evidence as state witness said all the accused, including Yakub, were involved in planning, conspiracy, training, landing and planting of RDX-laden bombs that eventually killed 257 persons and left 713 injured.<\/p>\n<p>The Supreme Court said Khan was &#8220;a reliable witness&#8221; despite inconsistencies.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-23742\" src=\"http:\/\/news.entecity.com\/files\/2015\/07\/yak-03.jpg\" alt=\"yak-03\" width=\"700\" height=\"400\" \/><\/p>\n<h2><strong>#5 Yakub was not aware of his brother Tiger Memon\u2019s involvement in terrorist activities<\/strong><\/h2>\n<p><strong>Truth:<\/strong> Read <strong>#2<\/strong> and <strong>#3<\/strong>. Yakub was convicted for criminal conspiracy, aiding, abetting and facilitating in a terrorist act, illegal possession and transportation of arms and ammunition, and possessing explosives with the intent to endanger lives. He also handled the finances of his brother Tiger&#8217;s illegal smuggling operations, mainly Silver. (<a href=\"http:\/\/indiatoday.intoday.in\/story\/ten-things-to-know-about-yaqub-memon\/1\/451465.html\" target=\"_blank\">Source<\/a>)<\/p>\n<h2><strong>#6 Yakub was hanged unfairly<\/strong><\/h2>\n<p><strong>Truth:<\/strong> Nobody can claim Yakub Memon was hanged unfairly. The Supreme Court heard his pleas repeatedly, including late into the night. President heard his mercy petitions twice, and the Maharashtra Governor once &#8211; and all this, mind you, after Memon was convicted. Unlike the UPA, which failed to follow basic courtesies like informing the family in the case of Afzal Guru&#8217;s hanging, the NDA government in Maharashtra did not act in a cowardly fashion and has allowed Memon&#8217;s family to claim the body and conduct the last rites in Mumbai. Tiger\u2019s plan would have failed if they had refused to join him. Not only did they NOT do it, they helped him in achieving the goal.<\/strong> In a way, Yakub Memon is the bigger criminal here for extending the scale of the killings with his logistic support. Tiger alone could have killed a dozen, maybe.
